Terms and Conditions - Garden Maintenance Lee

Welcome to Garden Maintenance Lee. These Terms and Conditions govern your use of our services. By hiring us, you agree to comply with and be bound by these terms.

1. Services Provided

We offer a range of garden maintenance services, including but not limited to:

Lawn Mowing: Regular mowing to maintain lawn health.
Pruning: Trimming of shrubs and trees to promote growth.
Weeding: Removal of unwanted plants to keep gardens tidy.
Fertilizing: Application of nutrients to enhance plant growth.
Mulching: Spreading mulch to retain soil moisture.

2. Payment Terms

Payment for services is due as follows:

Invoicing: Invoices are issued at the end of each month for services rendered.
Payment Methods: We accept bank transfers, checks, and major credit cards.
Late Payments: A late fee of 5% per month may be charged on overdue invoices.

3. Scheduling and Cancellations

To ensure efficient service delivery:

Scheduling: Services are scheduled based on mutual availability. We will provide a maintenance calendar outlining service dates.
Cancellations: Cancellations must be made at least 48 hours in advance. Failure to do so may result in a cancellation fee.
Rescheduling: We strive to accommodate rescheduling requests, subject to availability.

4. Customer Responsibilities

Customers are expected to:

Access: Provide access to the garden areas to be maintained.
Preparation: Remove any obstacles or hazards that may impede our work.
Communication: Inform us of any specific requirements or preferences regarding garden maintenance.

5. Liability

We are committed to providing quality services. However:

Property Damage: We are liable for any direct damage caused by our negligence during service provision.
Exclusions: We are not responsible for pre-existing conditions, natural wear and tear, or issues arising from external factors beyond our control.
Insurance: We carry appropriate insurance to cover potential liabilities.

6. Termination

Either party may terminate the service agreement under the following conditions:

Notice Period: A written notice of 30 days is required for termination.
Breach of Terms: Immediate termination may occur if either party breaches these terms.
Final Settlement: All outstanding payments must be settled upon termination.

7. Governing Law

These terms are governed by the laws of the jurisdiction in which Garden Maintenance Lee operates. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the local courts.

8. Changes to Terms

We reserve the right to modify these terms at any time. Customers will be notified of significant changes at least 30 days prior to implementation. Continued use of our services constitutes acceptance of the updated terms.

9. Privacy Policy

Your privacy is important to us. We collect and use your personal information solely for service provision and will not share it with third parties without your consent, except as required by law.

10. Force Majeure

Garden Maintenance Lee is not liable for any failure to perform services due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, or other unforeseen events.

11. Intellectual Property

All materials, including documentation and branding, provided by Garden Maintenance Lee remain our property. Customers are granted a limited, non-transferable license to use these materials solely for personal use.

12. Indemnification

You agree to indemnify and hold Garden Maintenance Lee harmless from any claims, damages, or expenses arising from your misuse of our services or violation of these terms.

13. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full effect.

14. Entire Agreement

These terms constitute the entire agreement between you and Garden Maintenance Lee regarding the services provided and supersede all prior agreements or understandings.
